These Terms of Service (“Terms”) govern your use of the Theta mobile application (the “App”) operated by On World Tech LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Theta is an app for bringing photos and videos from a compatible camera to your iPhone. It connects to your camera over Bluetooth and the camera’s own Wi-Fi, shows the photos on the camera’s card, and saves the ones you bring into your Photos library. Theta never deletes files on your camera’s card. The App contains no advertising.

3. Camera Compatibility and Third-Party Marks

  • Theta works with Sony Alpha bodies that support smartphone connection, including α1 II, α7R VI and α7 V.
  • Camera behavior depends on the camera model, its firmware and its settings, which we do not control. We do not warrant that every camera, firmware version or setting will work with the App, or that a camera that works today will keep working after a firmware update.
  • Theta is not affiliated with or endorsed by Sony Corporation. Sony, Alpha and related names are trademarks of their respective owners and are used only to describe compatibility.

4. In-App Purchases and Subscriptions

4.1 Theta Pro

  • The App is free to download and use with one camera. Using more than one camera requires Theta Pro.
  • Theta Pro is an auto-renewing yearly subscription ($19.99 USD per year). Prices may vary by region, and the price shown in the App at purchase applies.
  • The subscription includes a 3-day free trial for new subscribers. Unless you cancel at least 24 hours before the trial ends, it converts to a paid yearly subscription.
  • The subscription renews automatically each year unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel the subscription in your Apple ID settings: Settings › Apple Account › Subscriptions.
  • You can restore your purchase at any time from the App (Restore).

4.2 Payment and Refunds

All purchases are processed through Apple’s App Store. Payment is charged to your Apple Account at confirmation of purchase. Refund requests must be directed to Apple in accordance with their refund policy. We do not process payments or refunds directly.

5. Your Content

You retain ownership of the photos and videos you bring with the App. We do not claim any rights to your content, and it is not sent to us.

6. Acceptable Use

You agree to use the App only for lawful purposes, only with cameras you own or are allowed to use, and in accordance with these Terms. You must not use the App in any way that violates applicable local, national, or international laws or regulations.

7. Intellectual Property

The App and its original content, features, and functionality are owned by On World Tech LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8. Apple’s Standard EULA

Your use of the App is also subject to Apple’s Licensed Application End User License Agreement. If these Terms and that agreement conflict, these Terms apply to the extent permitted by Apple’s terms.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that it will work with any particular camera or firmware. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, On World Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data (including photos or videos), arising from your use of or inability to use the App. Keep the files on your card until you have confirmed they are where you want them.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
